Terms of Service

1. Who these terms are with
These terms are an agreement between you and شركة بيبس كارد لبيع البرمجيات غير المعدة بناء على الطلب, the company that operates the PIPPS platform and the website at pipps.co. By using the website, the PIPPS apps or the PIPPS dashboard you agree to them. If you do not agree, do not use the service.
2. What PIPPS provides
PIPPS is software that lets a business run a customer loyalty programme: issue loyalty cards and coupons, award and redeem points, manage staff accounts and view reporting on its own programme, through a partner dashboard and mobile applications.
A business may agree separate commercial terms with us covering matters such as price, term and support. Where those signed terms conflict with these terms, the signed terms take precedence for that business.
3. Responsibilities of the business using PIPPS
If you use PIPPS to run a loyalty programme, you are responsible for:
- the accuracy of what you tell your customers about your programme, including how points are earned, what they are worth and when they expire;
- honouring the points, rewards and coupons you issue — PIPPS records them, it does not fund or guarantee them;
- having a lawful basis for the customer data you put into PIPPS and for any message you ask us to send on your behalf, including obtaining consent where consent is required;
- keeping your account credentials secure, managing the staff accounts you create and removing staff who leave;
- complying with the laws that apply to your business and to your programme.
4. Responsibilities of end customers
If you take part in a loyalty programme run on PIPPS, that programme belongs to the business, not to us. Your points, rewards and coupons are a matter between you and that business.
Give accurate information when you join, keep your account secure, and do not attempt to obtain points, rewards or coupons you have not earned.
5. Acceptable use
You must not:
- use PIPPS to do anything unlawful, or to help anyone else do so;
- upload, store or send content that is unlawful, deceptive, abusive, or that infringes someone else’s rights;
- send unsolicited marketing to people who have not agreed to receive it;
- attempt to gain unauthorised access to the platform, to another user’s account or to data you are not entitled to;
- interfere with, overload or disrupt the service, or probe or scan it without our written permission;
- copy, modify, decompile or reverse engineer the software, except to the extent the law allows you to;
- resell, sublicense or otherwise make access to the service available to a third party without our agreement.
6. Wallet passes and WhatsApp messages
Where a loyalty card or coupon is delivered as a wallet pass, the pass is issued to the wallet application on your device. That application is provided by a third party under its own terms.
Where messages are sent over WhatsApp, delivery depends on WhatsApp and on the phone number provided, and is subject to WhatsApp’s own policies. Messages are sent only where you or the business you deal with has a lawful basis to send them. You can opt out at any time by replying to the message or by writing to info@pipps.co.
We cannot guarantee that a pass or a message will be delivered, or that a third-party platform will remain available or continue to support a feature.
7. Intellectual property
The PIPPS platform, apps, dashboard, website, name and logo belong to us or to our licensors. Using the service does not transfer any of that to you. While your account is active and these terms are being met, you have a limited, non-exclusive, non-transferable right to use the service for its intended purpose.
Content a business puts into PIPPS — its brand, its offers and its customer data — remains that business’s. It grants us only the permission we need in order to host and process that content in providing the service.
8. Availability
We aim to keep PIPPS available, but we do not promise uninterrupted or error-free service. We may suspend the service for maintenance, and we may change, add or withdraw features. Where it is practical to do so, we will give notice in advance.
9. Liability
To the fullest extent permitted by the law of the State of Kuwait, we are not liable for loss of profit, loss of business, loss of goodwill, loss of data, or any indirect or consequential loss, nor for the monetary value of points, rewards or coupons issued by a business through PIPPS.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
10. Suspension and termination
You may stop using PIPPS at any time.
We may suspend or end access where these terms are breached, where use of the service is unlawful or puts the platform or other users at risk, or where an account is unpaid or dormant.
When access ends, the right to use the service ends with it. Data is then handled as described in our Privacy Policy and Data Deletion page.
11. Changes to these terms
We may update these terms. The date shown at the top of this page tells you when they last changed. Continuing to use the service after a change means you accept the updated terms.
12. Governing law
These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of the State of Kuwait. The courts of the State of Kuwait have jurisdiction.
